PRIZE DRAW TERMS AND CONDITIONS

1.  The Promoter of this prize draw is Silent Disco Events Limited t/a silent-discos.co.uk of 259 Copnor Road, Portsmouth, Hampshire, PO3 5EE.
2. The prize draw is open to all UK residents aged 18 years or over, except employees of the Promoter, their families, agents or any third party directly associated with administration of the prize draw.
3. The prize draw is free to enter and no purchase is necessary
4. All entries must be submitted via www.silent-discos.co.uk/competition only one entry per person is permitted.
5. The opening date for entries is 12am on 3rd May 2024. The closing date of the prize draw is 11.59am on 23rd May 2024. Entries received after this time will not be considered for this prize.
6. The Promoter accepts no responsibility for entries not successfully completed due to a technical fault [technical malfunction, computer hardware or software failure, satellite, network or server failure] of any kind.
7. A winner will be chosen by random draw performed by a computer process on 22nd May 2024.
8. The winner will receive 1 Free tickets to our Silent Disco Showdown event taking place on 24th May 2024 at the Village Hotel Portsmouth.
9. The winner will be notified by email (using details provided at entry) before 23rd May 2024 and must provide a email address to claim their prize. If a winner does not respond to the Promoter within 2 days of being notified by the Promoter, then the winner’s prize will be forfeited and the Promoter will be entitled to select another winner in accordance with the process described above.
10. The prize will be sent to the winner by email within 1 day of being notified of their win.
11. The prize for the winner is non-exchangeable, non-transferable and no cash alternative is offered.
12. The decision of the Promoter regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.
13. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname and county of major prize winners and, if applicable copies of their winning entries, to anyone who emails marcos@flamingoboss.co.uk or writes to Competitions, Flamingo Boss, 57 Copythorn Road, Portsmouth, PO2 0EB (enclosing a self-addressed envelope) within one month after the closing date stated in condition 5. If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter marcos@flamingoboss.co.uk. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
14. Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry, or refuse to award the prize to anyone in breach of these terms and conditions.
15. The Promoter reserves the right to hold void, cancel, suspend, or amend the promotion where it becomes necessary to do so.
16. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
17. Personal data supplied during the course of this promotion will only be processed as set out in the Promoter’s privacy policy. See also clause 14 with regard to the announcement of winners.
18. The Promoter may at any time assign, transfer, mortgage, charge, subcontract or deal in any other manner with all or any of its rights under this Agreement and may subcontract or delegate in any manner any or all of its obligations under this Agreement to any third party or agent.
19. These terms and conditions constitutes the entire agreement between the parties and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.
20. Each party agrees that it shall have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these terms and conditions. Each party agrees that it shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in these terms and conditions.
21. These terms and conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
22. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these terms and conditions or their subject matter or formation (including non-contractual disputes or claims).
